I parked in a car park to go to the footy and I simply forgot to take
a ticket, I am used to car parks where you have to take a ticket to
open the boom to get in, and I just simply forgot. it was one of
those parks where you drive in and have to walk to a machine. the fee
should have been $10 which I would have paid when I left but I had a
ticket on my windscreen with a bill for $88 for "breach of contract"

Does a contract really exist simply because I drove in to their car
park, Doesnt their have to be an acknowledgement of an agreement from
both sides to form a contract?

The problem you have is that you knew all the rules. But you "simply
forgot" to carry out one part of the arrangement - normal payment.

Whining won't get you anywhere.

Refuse to pay , they will drop it and make sure you tell them the
machine was on the fritz

can't be proven otherwise , include the fee when you send the letter

Refuse to pay , they will drop it and make sure you tell them the
machine was on the fritz
can't be proven otherwise , include the fee when you send the letter
Don't pay before you check the legals on the car park system that you
were in . There is a scamlike questionable system run by an iffy mob
which does not have a very high collection rate if you do not pay.
Some MacDonald car parks and aldi car parks run this system
I think some council car parks have a system like this where you do have
to pay.

** Not in the case of a " unilateral contract ".

The car park operator makes an open offer detailed on a sign and persons are
able to accept that offer by driving their car inside and parking.

So, by not paying at the time or way detailed on the sign, you breached the
contract.

Was the $88 penalty mentioned on any sign ??
